These Terms of Service govern your use of the Crateflow website and services. We offer our services exclusively to business users (B2B). By using our services, you confirm that you are acting in a business capacity and agree to these Terms.

1. Description of Service

Crateflow (“we,” “us,” or “our”) provides AI-powered inventory management solutions to help businesses optimize their operations.

2. User Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must ensure your users comply with these Terms.

3. User Data and Privacy

We collect and process personal data as necessary to provide our services and to respond to demo/lead requests. For details on how we handle your data, please see our Privacy Policy.

4. Acceptable Use

You agree to use our services lawfully and in accordance with these Terms. You will not:

• Violate any applicable laws or regulations
• Interfere with or disrupt the functionality or security of our services
• Engage in any conduct that restricts or inhibits anyone else’s use of our services

5. Intellectual Property

All content, features, and functionality of our services are owned by Crateflow or its licensors and are protected by copyright, trademark, and other intellectual property laws. No rights are granted except as necessary to use the services in accordance with these Terms.

6. Warranties

To the maximum extent permitted by law, the services are provided “as is” without warranties. Statutory rights in cases of intent, gross negligence, or injury to life, body, or health remain unaffected.

7. Limitation of Liability

Crateflow is not liable for indirect, incidental, special, consequential, or punitive damages. For other damages, our aggregate liability is limited to the fees paid by you for the services in the twelve (12) months preceding the event, except for mandatory liability under applicable law (e.g., intent, gross negligence, injury to life, body, or health).

8. Data Processing

We process personal data as a controller for leads and as a processor where applicable. We use trusted sub-processors (e.g., Microsoft Azure, MongoDB Atlas, Calendly after consent) under appropriate data processing agreements and safeguards. You remain responsible for providing accurate and lawful instructions.

9. Term and Termination

We may suspend or terminate access if you materially breach these Terms or legal requirements. You may stop using the services at any time. Provisions that by their nature should survive (e.g., liability limits, IP, governing law) will remain in effect.

10. Governing Law and Venue

These Terms are governed by the laws of Germany. Exclusive venue is Worms, Germany, provided no mandatory consumer jurisdiction applies (which is excluded because the services are B2B).

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any significant changes via email or through our website. Continued use after updates constitutes acceptance.
